These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you” or “your”) and Hadithiz (“Hadithiz”, “we”, “our” or “us”), governing your access to and use of the Hadithiz website, applications, services, and related features (collectively, the “Platform”).

By accessing, registering, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Nature of the Platform

Hadithiz is a digital marketplace and educational platform focused on children’s books and learning content. The Platform facilitates transactions between buyers (parents or guardians) and independent publishers or vendors.

Hadithiz does not act as a publisher, author, or distributor of books unless explicitly stated.

2. Eligibility & Account Registration

Account registration is permitted only for individuals aged 18 years and above. Children may access educational or interactive features only under parental or guardian supervision.

You agree to provide accurate and complete information during registration and to keep your account details up to date.

3. User Responsibilities

  • Maintain confidentiality of login credentials
  • Ensure lawful and appropriate use of the Platform
  • Supervise children’s access and interactions
  • Refrain from misuse, abuse, or exploitation of content

4. Purchases, Payments & Settlement

All payments on Hadithiz are processed electronically. Once an order is completed and confirmed, funds are settled in real time to the respective vendor.

Hadithiz is not responsible for delays arising from incorrect user details, vendor fulfilment issues, or third-party delivery partners.

5. Delivery, Returns & Disputes

Delivery of physical products is handled by vendors or their designated fulfilment partners. Any delivery disputes must be raised within a reasonable period as specified on the Platform.

Hadithiz reserves the right to mediate disputes but does not guarantee refunds unless legally required.

6. Vendor & Publisher Obligations

Vendors are solely responsible for:

  • Accuracy of product descriptions
  • Intellectual property ownership or licensing
  • Child-appropriate and lawful content
  • Timely fulfilment of orders

7. Intellectual Property Rights

All platform software, branding, designs, and system architecture are the intellectual property of Hadithiz. Content uploaded by vendors remains the property of the respective rights holders.

8. Prohibited Conduct

  • Uploading unlawful, harmful, or misleading content
  • Attempting unauthorized access or system interference
  • Misuse of child-focused features
  • Fraudulent or deceptive activities

9. AI & Interactive Features

Certain interactive or AI-driven features are designed for educational enrichment. Outputs generated are informational and creative in nature and should not replace professional advice.

10. Suspension & Termination

Hadithiz reserves the right to suspend or terminate accounts for violations of these Terms, applicable laws, or child safety standards.

11. Limitation of Liability

To the maximum extent permitted by Kenyan law, Hadithiz shall not be liable for indirect, incidental, or consequential damages arising from platform use.

12. Indemnity

You agree to indemnify and hold harmless Hadithiz from any claims arising from your misuse of the Platform or violation of these Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
